Yes, they will be able to terminate. But it won't be sunshine and rainbows like the girls and their fandom are being lead to believe.

It's pretty clear at this stage that the relationship between Ador and NewJeans is ruined and cannot be salvaged. NewJeans does not trust the new people put in charge at Ador, and the new people at Ador will be constantly walking on eggshells around them going forward. There is nothing that Ador can do at this stage that will make NewJeans feel comfortable being there - not even if Min Heejin gets her CEO role back, which is not going to happen.

So the next step is to file for termination like they have stated they would be doing if their concerns are not addressed. The thing many people need to remember here is that NewJeans is not contracted to Hybe directly, but to Ador. I'm assuming they're going with the mistreatment angle on this, but it becomes their burden to prove said mistreatment has happened at the hands of Ador. Problem is...almost all of their public grievances are related to other parties, not Ador. The hallway incident, the deleted bonus content, the poor living conditions pre-debut, etc. I am not convinced that they have some kind of hidden bombshell yet to be revealed that would put the final nail in the coffin, either. They have had many opportunities to share such information and it would get the public to support them even harder if known...but they are just doubling down on the same incidents that we've been hearing about for months now. So given the information we know, if there's truly nothing else, it's not likely that the court will rule in their favor.

I'm not sure where the narrative has come from that HYBE/Ador are restricting the group's activities, either. I have seen tons of content being released by the group over the last 7 months that this has been unfolding, including new magazine photoshoots, new global CF deals, a Tokyo Dome fanmeeting, and scheduled award show appearances. I don't doubt that there have been some internal plans that have been slowed down (I think they were supposed to have another album this year), but I'm not going to lie, the fault falls on NewJeans for that situation - there have been proposed compromises from the Ador side with Min Heejin being offered an internal director role where she would still be able to work with the girls. It's pretty clear to me that Ador wants them working and is trying to meet them halfway. But NewJeans refuses to compromise, saying they only want to work if Min Heejin is their CEO and they don't want her to only be a director. This is honestly not going to help their case in court.

This being said, they definitely can still terminate their contracts. They're just going to have to come up with the money for the termination fee (which is not going to be pretty) and they are likely also going to lose the rights to all of their IP and be forced to start completely anew...no pun intended.

I'd say I don't know but if I can bet on one of the other choices : then yes, they will.

HYBE is a huge mess of course but I don't see how NJ can even work, promote or comeback properly when the situation is so tense and so toxic. There's no way both side are willing to reconciliate.

So the "best" way is to break it once and for all. However it won't be easy at first since but NJ are still very popular so they'll be okay and people will want to work with them, with ou without HYBE.
But they'll have to pay a lot of money and lose their IP.

NJ seems to only wants to work with MHJ, their relation is beyond the simple employee - employer relationship. So they better create their own company at this point.

It's a lose lose situation for HYBE regardless, for NJ only time will tell but I think they'll keep their popularity if this issue doesn't last another year.

NJ seems to only wants to work with MHJ, their relation is beyond the simple employee - employer relationship. So they better create their own company at this point.

There is an additional issue though which is that they can’t. When hype was first signing in MHJ they had her sign a non-compete which currently has no expiration date
(I’m still genuinely shocked she signed a contract with these terms in the first place).

I highly doubt NJ will get a non-compete, but they won’t ever get to work with MHJ again (or at least until an end date to the non compete is negotiated)
